Talking Points

The SAVE Act (Safeguard American Voter Eligibility Act) is being promoted as a measure to prevent noncitizens from voting, but it's important to note that noncitizen voting in federal elections is already illegal. The SAVE Act is widely criticized for being a voter suppression tactic that disproportionately affects certain communities. Here are some suggested talking points to help people understand its negative impact:

🔍 Framing the Issue Clearly

  • The SAVE Act is a solution in search of a problem—noncitizen voting in federal elections is already illegal and extremely rare—it’s estimated that less than .05% of all votes cast in 2024 were fraudulent.

  • This bill isn’t about protecting elections—it’s about making it harder for eligible Americans to vote.

⚖️ Disproportionate Impact on Marginalized Communities

  • The SAVE Act could disenfranchise millions of eligible voters, especially naturalized citizens, young people, and communities of color.

  • It creates unnecessary barriers to voter registration by requiring documentary proof of citizenship, which many citizens don’t readily have.

📄 Documentation Issues

  • Many Americans don’t have immediate access to documents like a birth certificate or passport. This would make it harder for them to register or vote—especially low-income individuals, elderly voters, and those in rural areas.

  • Naturalized citizens might face extra scrutiny under this law, even though they’re fully eligible to vote.

🚫 Suppressing the Vote Under False Pretenses

  • This bill is being pushed under the false narrative of widespread noncitizen voting—something that’s not backed by evidence.

  • By stoking fear, the SAVE Act diverts attention from real threats to democracy—like voter suppression and gerrymandering.

🧾 Administrative Burdens

  • This law would create new bureaucratic hurdles for election officials, increasing the risk of errors and delays.

  • It would force election offices to act as immigration verification agencies, which is not their job or area of expertise.

📉 Undermining Democracy

  • Restricting access to the ballot undermines the foundations of democracy. We should be making it easier—not harder—for eligible Americans to vote.

  • Instead of expanding voter access and participation, the SAVE Act sets a dangerous precedent of exclusion.

Better Alternatives

  • If we want secure elections, we should invest in modernizing voting systems, expanding access to early and mail-in voting, and protecting against voter intimidation—not implementing discriminatory ID laws.
